Sometimes this document is called a Last Will and Testament. A will is a legal document that describes how a person’s property will be distributed at the time of death. When a person dies with a valid Will, the person dies testate.
Should a person die without having a Will, the person dies intestate. When a person dies intestate, state law interpreted by a local probate court will determine what happens to the property and any minor children.
