This is a legal process that usually involves depositing a deceased person's Will with the local probate court, taking an inventory and getting appraisals of the deceased's property, paying all legal debts, and eventually distributing the remaining assets and property. This process can be costly and time-consuming. This process often requires about a year to complete.
In Florida, the amount that an attorney may charge for administering the probate process is set by state law. Regardless of the amount of legal work required to administer the estate, the legal fee is presumed reasonable so long as it does not exceed a certain amount. This amount is dependant on the amount of assets in the probate estate.
